PAYMENT LATAM
1. Identification of the data controller
PAYMENTS LATAM S.A.C., operating under the trade name Payment Latam (hereinafter, “Payment Latam”), recognizes the importance of protecting the image, voice, privacy, and personal data of individuals participating in its institutional, corporate, commercial, and promotional activities.
This policy establishes the criteria applicable to the capture, recording, storage, use, reproduction, editing, and dissemination of photographs, videos, audio recordings, and other audiovisual content that allow for the identification of, or make identifiable, a natural person.
2. Purpose
The purpose of this policy is to inform individuals of the conditions under which Payment Latam may process their image and/or voice, and to establish measures ensuring the responsible and respectful use of such content.
The processing of image and voice data will be carried out in accordance with applicable personal data protection regulations and other relevant provisions.
3. Scope
This policy applies to individuals whose image and/or voice may be captured or used by Payment Latam in the course of its activities, including, as applicable:
- Employees and collaborators.
- Company representatives.
- Clients.
- Suppliers.
- Business partners.
- Event participants and attendees.
- Exhibitors or interviewees.
- Other individuals voluntarily participating in Payment Latam’s institutional or promotional content.
The application of this policy does not, in itself, imply that Payment Latam is authorized to use a person’s image or voice when, in accordance with applicable regulations, it is necessary to obtain their prior consent.
4. Image and voice as personal data
When a photograph, video, audio recording, or other content allows a natural person to be identified or made identifiable, the image and/or voice will be treated as personal data.
Consequently, Payment Latam will process such data in compliance with the principles, rights, and obligations established in applicable personal data protection regulations and its own privacy policy.
5. Purposes
Where appropriate and subject to authorization or an applicable legal basis, Payment Latam may process the image and/or voice for the following purposes:
- Disseminate Payment Latam’s institutional and corporate activities.
- Communicate Payment Latam’s participation in events, training sessions, meetings, conferences, trade shows, or other business activities.
- Create informational content regarding Payment Latam’s activities and services.
Produce and distribute corporate and audiovisual material. - Publish content on Payment Latam’s official website.
- Publish content on Payment Latam’s official social media channels.
- Create advertising or promotional material related to Payment Latam and its services, provided that this purpose has been duly disclosed and authorized.
- Share previously authorized interviews, testimonials, or appearances.
Payment Latam will not use the image or voice for purposes incompatible with those disclosed to the data subject, unless there is legal authorization permitting such processing.
6. Consent
When the processing of an image and/or voice requires the data subject’s consent, Payment Latam will request it in advance using a mechanism that demonstrates a free, prior, express, unequivocal, and informed expression of will.
Consent may be obtained via physical documents, electronic forms, checkboxes, or other valid mechanisms that verify the data subject’s expression of will.
The authorization must disclose, as applicable, the purposes for which the image and/or voice will be used and the channels through which they may be disseminated.
Acceptance of the terms and conditions, the privacy policy, or this image and voice usage policy shall not, in itself, constitute general authorization to use the user’s image or voice for advertising or promotional purposes.
7. Media outlets
In accordance with the stated purpose and, where applicable, the authorization granted by the data subject, the image and/or voice may be disseminated via:
- Payment Latam official website.
- Official social media channels.
- Digital platforms used by Payment Latam.
- Corporate presentations and communications.
- Audiovisual material.
- Institutional material.
- Advertising or promotional material, when expressly authorized.
The holder acknowledges that publishing content on the Internet may allow it to be viewed from various territories and that third parties unaffiliated with Payment Latam could take actions beyond the company’s reasonable control.
8. Content editing
Payment Latam may make the technical adaptations necessary for the proper presentation of the authorized material, including cropping, resizing, formatting, lighting, sound, subtitles, graphic elements, and audiovisual editing.
Such modifications must align with the stated purpose and may not be used to substantially alter a person’s statements or to present their image or voice in a context that could unjustifiably affect their honor, reputation, privacy, or dignity.
9. Protection and security
Payment Latam will implement reasonable technical, organizational, and administrative measures designed to protect photographs, videos, recordings, and other content containing personal data against loss, alteration, or unauthorized access, processing, or disclosure.
The processing of such content will be carried out in accordance with the privacy policy published by Payment Latam.
10. Participation of third parties
To fulfill the stated purposes, Payment Latam may engage service providers for tasks related to photography, audiovisual production, design, editing, storage, web hosting, social media management, advertising, or communications.
When such providers have access to personal data on behalf of Payment Latam, they must process the information solely for the relevant purposes and in accordance with applicable obligations.
11. Retention period
Photographs, videos, recordings, and other content will be retained for the time necessary to fulfill the purposes for which they were collected or for as long as there is a legal basis justifying their retention.
Once the relevant purpose has been fulfilled, Payment Latam will take applicable measures regarding their retention, deletion, anonymization, or blocking, in accordance with current regulations.
12. Rights of the data subject
The data subject may exercise their rights regarding the processing of their personal data, including—where applicable—the rights of access, rectification, cancellation, and objection, as well as other rights recognized under applicable regulations.
Furthermore, where processing is based on consent, the data subject may request its revocation in accordance with applicable regulations.
Requests may be submitted via the contact channels made available by Payment Latam.
The revocation of consent shall not affect the lawfulness of processing carried out prior to such revocation.
13. Content removal
Where legally applicable, the data subject may request the cessation of use or the removal of content featuring their image and/or voice.
Payment Latam will evaluate and address the request in accordance with applicable regulations and will take reasonable measures regarding content under its administration or control.
Removal by Payment Latam from its own channels does not guarantee the deletion of copies that have been previously downloaded, shared, or reproduced by third parties beyond its control.
14. Minors
Payment Latam will exercise special caution regarding the processing and dissemination of images or voices of minors.
When authorization for their use is required, it must be obtained in accordance with the rules applicable to children and adolescents, taking into account the involvement of their parents, guardians, or legal representatives where required.
Payment Latam will not knowingly use the image or voice of minors for advertising or promotional purposes without the appropriate authorization.
15. Unauthorized uses
Payment Latam will not knowingly use a person’s image or voice:
- For purposes different from or incompatible with those previously disclosed.
- In a misleading, offensive, or discriminatory manner.
- In a way that unjustifiably affects their honor, privacy, reputation, or dignity.
- To attribute statements to them that they did not make.
- To create manipulated content that substantially alters their identity, appearance, or statements without the corresponding authorization or legal entitlement.
16. Relationship with the privacy policy
This policy complements the Payment Latam Privacy Policy.
Aspects related to personal data protection that are not specifically addressed in this document shall be governed by the Privacy Policy and applicable regulations.
17. Modifications
Payment Latam may modify or update this policy to adapt it to regulatory, technological, or operational changes, or changes related to its activities.
Modifications will be published on the Payment Latam website and will be effective upon publication, without prejudice to the requirement that any new processing purposes requiring consent be disclosed and authorized in accordance with applicable regulations.
