Privacy Policy and Protection of Personal Data
In compliance with the provisions of Law No. 29733, Personal Data Protection Law and its regulations approved by Supreme Decree No. 003-2013-JUS (hereinafter, “the Law”), PAYMENTS LATAM SAC (hereinafter Payment) wishes to put In the knowledge of all its users, the policy applicable to the processing of their personal data (hereinafter, “the Policy”).
Area of application
This Policy applies to all personal databases in the possession of Payment and those in charge of the Processing of Personal Data that work on behalf of Payment, in this way they will be applicable to the personal data registered in any database that make them susceptible to treatment by Payment, with the limitations and restrictions that the Law itself establishes.
About the Use of the Web Page, Acceptance of Terms and Conditions
This website belongs to Payment, identified with RUC 20603630506, domiciled at Av. Arequipa N° 4704 Office 1006 district of Miraflores, province and department of Lima; being operated for the benefit of Payment. This Policy, which is available to the general public, has the purpose of informing our users of the conditions on how Payment treats the personal data obtained through our different channels, detailing the purposes of said treatment, the circumstances of its transfer to third parties and the rights of the User regarding their personal information.
The use of this website implies knowledge of the conditions set forth in this Policy, which must be read in conjunction with the terms and conditions and other specific documents that apply to each case, which will be exposed.
Likewise, Payment informs you that when you decide or request to be contacted to obtain information about a product, service, raffle or benefit campaign, the personal data you provide through virtual forms, WhatsApp or other applicable channels, will be necessary to attend and/or process your decision or request, as without this data Payment will not be able to contact you.
In this sense, all information that you provide will be duly treated, complying with the legal stipulations contained in the Law. When we request to fill in the personal information fields, we do so ensuring that said information will only be used in accordance with the terms of this document and when corresponds, other applicable specific documents, which will be made available to you prior to any acceptance.
This Policy may change over time or be updated, so we recommend and emphasize that you continually review this page to ensure that you agree with the conditions of treatment of your information.
Authorization
The collection, storage, use, circulation or deletion of personal data by Payment requires the free, prior, express and informed consent of the owner thereof.
Payment, at the time of the collection of Personal Data, will request an authorization from the Holders, informed about the specific purposes of the Treatment for which said consent is obtained.
The authorization of the Holders may be manifested by any of the following means: (i) written, ( ii ) orally or ( iii ) through unequivocal conduct that allows a reasonable conclusion that the authorization was granted.
Thus, the authorization may consist of a physical or electronic document, data message, Internet, Web Sites, or in any other format that allows guaranteeing its subsequent consultation, or through an appropriate technical or technological mechanism that allows expressing or obtaining the consent via click or double click, through which it can be unequivocally concluded that if the owner had not behaved, the data would never have been captured and stored in the database. The authorization will be generated by Payment and will be made available to the owner in advance and prior to the processing of their personal data.
Payment will keep proof of said authorizations in an appropriate manner, respecting the principles of confidentiality and privacy of information.
In accordance with the provisions of article 14 of Law 29733, this authorization will not be necessary when the information refers to: (i) Information required by a public or administrative entity in the exercise of its legal functions or by court order; ( ii ) Public Data; ( iii ) Cases of medical or health urgency; ( iv ) Treatment of information authorized by law for historical, statistical or scientific purposes; and (v) Data related to the Civil Registry of People.
Specific Purposes of the Processing of Personal Data
Payment, in the development of its corporate purpose and its relations with third parties, understood by these users, businesses, employees, suppliers, creditors, among others; constantly collects data to carry out various purposes and uses within which the following can be framed and that by accepting this policy you expressly authorize:
Payment, within its corporate purpose and with the purpose of developing the aforementioned activities, collects from its Holders information regarding their Personal Data, such as : name, address, telephone number, identity document, email, labor data, data of your family nucleus, academic training data, financial data, among others.
Requested data
Our website, virtual forms or corresponding channels (for example: WhatsApp), may capture and/or manage personal information, for example: your opinion if you decide to leave your comments or suggestions in surveys, your tastes or preferences if you agree to continue with the browsing our website, you can also send us your queries and exercise your rights over personal data to the email administracion@payment-latam.com
Once you provide your personal data, it will be stored in different secure media that technology allows, and its access will be limited exclusively to natural or legal persons who require it in order to fulfill the purposes described above. In case of requirement of any authority, your personal data may be made available to them, within strict compliance with the Law.
Procedure to Update, Rectify and Delete the Information:
The Holders of the Personal Data or their successors in title may, at any time, request Payment to update, rectify or delete their data and/or revoke the authorization of their treatment by Payment, by submitting a claim to the email administracion@payment-latam.com or to the address Av. Arequipa N° 4704 Office 1006, in which the facts that give rise to the claim are indicated, the physical address or email in which a response must be given, and the documents that you want to enforce.
If the claim is incomplete, the applicant will be required within five (5) days of receipt of the claim to correct the failures. After two (2) months from the date of the request, without the applicant submitting the required information, it will be understood that the claim has been withdrawn.
In the event that the person receiving the claim is not competent to resolve it, they will transfer it to the corresponding person within a maximum term of two (2) business days and inform the applicant of the situation.
Once the complete claim is received, a legend that says “claim in process” and the reason for it will be included in the database, within a term of no more than two (2) business days. Said legend must be maintained until the claim is decided.
The maximum term to address the claim will be fifteen (15) business days from the day following the date of receipt. When it is not possible to address the claim within said term, the applicant will be informed of the reasons for the delay and the date on which the claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the first term.
It is essential to note that the request to delete the information and the revocation of the authorization will not proceed when the Holder has a legal or contractual duty with Payment.
Period of Conservation of Data and Security Measures
The personal data provided will be kept for the time required for the fulfillment of the purpose or specific purposes authorized by the user. Likewise, we may, by virtue of regulatory provisions, keep your information after the end of the commercial relationship between you and Payment, establishing in this case, a maximum conservation period of 5 years after the end of said commercial relationship.
Processing of Financial and Commercial Data
Payment may process commercial data and financial information that is necessary for the fulfillment of its corporate purpose and for the execution of contracts with third parties. The data will be treated in full consistency with the financial habeas data statutory law. Said treatment will be limited to the activities of the ordinary course of their business and no benefit will be obtained with their employment.
Transmission of Data for Treatment by National Third Parties
The acceptance of this policy implies for the owner of the personal data the acceptance of the possibility that Payment has, respecting at all times the legal provisions that regulate the matter, to transmit all the data of the owner to third parties in the country.
In turn, Payment may carry out the transmission of all personal data, as long as the applicable legal requirements are met; and consequently the holders with the acceptance of this policy, expressly authorize to transmit the personal data. The data will be transmitted for all relationships that may be established with the company.
What information PAYMENTS LATAM SAC collects
Eventually PAYMENTS LATAM SAC may request information from its clients, whose response in any case will be voluntary. This information will be used to link them to the company’s products and services and achieve a better understanding of their tastes, preferences and needs. Likewise, to keep them informed about new products, services and promotions. In order to link it with our service platform, it is necessary that you provide us with the following information, among others: name, ID, residence address, business address, personal telephone numbers, email and data such as name and telephone number of personal and commercial references. This information will be used to carry out the linking operation to the platform services.

PAYMENTS LATAM SAC does not sell, commercialize, or transfer the personal information that you voluntarily decide to give us. PAYMENTS LATAM SAC is protected by a firewall, a tool that allows us to control the reliability of the data in our system. Our users’ personal information is only accessible by a limited number of people who have special access rights to these systems and who are committed to maintaining the confidentiality of the data.
